INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA
pursuant to art. 13 of Regulation (EU) 2016/679 (GDPR)

 

In compliance with the provisions of art. 13 of Regulation EU 2016/679, FOGAL REFRIGERATION s.r.l. would like to inform you that your data will be processed, in compliance with the principles of fairness, lawfulness, transparency and protection of your confidentiality and your rights, with the methods and for the purposes set out below.

 

1) Data Controller.

The Controller of the data provided by you is the undersigned company FOGAL REFRIGERATION s.r.l., with headquarters in Ronchi dei Legionari (GO) in via Tambarin no. 1, telephone +39 0481 777450, e-mail: privacy@fogalrefrigeration.com.

 

2) Data processed, purpose of and legal basis for the processing.

As part of the business activity, we will process personal identification data that you have disclosed to us, such as name and surname, company name, tax code, address, telephone number, fax number, e-mail address, banking, payment and financial details, for the following purposes:
A. to fulfil the pre-contractual and contractual obligations related to the requested service;
B. to fulfil the obligations envisaged by laws or regulations, by EU legislation, by requests of the tax, fiscal and judicial Authorities;
C. to exercise the rights of the Controller, including, for example, the right of defence in court;

The legal basis that legitimises the processing of the data referred to in point « A. » is the performance of the contract to which you are a party, or the performance of pre-contractual activity at your request; for point « B. », the legal basis is the fulfilment of legal obligations or compliance with regulations; for point « C. », the legal basis is the pursuit of the legitimate interest of the Data Controller.

 

3) Nature of the provision.

The provision of personal data relating to the processing is optional. However, failure to provide the data in whole or in part may result in the partial or total inability to establish or continue the relationship with you, to the extent that such data are necessary for the performance thereof.

The provision of data for marketing purposes is also optional. You can therefore decide not to provide any data or subsequently deny the processing of any data already provided: in this case you will not be able to receive newsletters, commercial communications and advertising material in general concerning the services offered by the Controller.

 

4) Processing methods.

Your personal data will be processed on paper and/or by computerised and/or telematic means and will be entered into the relevant databases which the persons in charge of the processing can access.
The processing may also be carried out by third parties who provide specific processing, administrative or instrumental services necessary to achieve the aforementioned purposes.
All data processing operations performed on your personal data shall be carried out in such a way as to guarantee the integrity, confidentiality and availability of the personal data.

 

5) Recipients or possible categories of recipients of the personal data.

The processing of your data is carried out by the Controller’s internal staff (employees, collaborators, etc.) identified and authorised for the processing in accordance with instructions provided in compliance with current legislation on privacy and data security.
If necessary for the purposes listed above, your personal data may be processed by third parties appointed as Data Processors (pursuant to Article 28 of the GDPR) or « Independent » Data Controllers, namely:

  • by professionals, companies, associations or professional firms that provide assistance or consultancy services to the Controller for administrative, accounting, tax purposes;
  • by representatives, sales agents, collaborators, who manage relationships on behalf of the Controller;
  • by all Public Institutions established by law and more generally by all the Bodies envisaged by current accounting and tax regulations as recipients of mandatory disclosure;
  • by banks for collection and payments, as well as by any professionals, for the management of the payments through factoring, credit cards or electronic payment instruments in general, and for the possible recovery of credits:
  • by commercial information companies.However, the Customer’s personal data shall not be subject to dissemination.

 

6) Transfer of the data to a third country or to international organisations.

No transfer of your data to non-EU third countries or to international organisations is envisaged as part of the management of the contractual relationship.

 

7) Data retention period.

For the purposes referred to in points « A. », « B. » and « C. », your personal data will be processed and retained by the Controller for the entire duration of the contractual relationship and, at the end of the same on any grounds whatsoever, for the time required by current accounting, tax, civil and procedural law.

 

8) Rights of the Data Subject.

As a Data Subject and in relation to the processing described in this Information Notice, the Data Subject has the rights referred to in articles 7, 15 to 21, and 77 of the GDPR (right of access, rectification, erasure, restriction of processing, right to data portability, right to object, withdraw consent, lodge a complaint). In particular, the Data Subject has the right to lodge a complaint with the Italian Data Protection Authority with offices in Piazza Venezia 11, 00187, Rome (RM).

The Data Subject may at any time exercise his or her rights by sending a registered letter with return receipt. to: FOGAL REFRIGERATION s.r.l., 34077 Ronchi dei Legionari (GO), via Tambarin no. 1, or an e-mail to: privacy@fogalrefrigeration.com.

The Data Subject may exercise his or her rights free of charge pursuant to article 12 of the GDPR. However, should the requests prove manifestly unfounded or excessive, also due to their repetitive nature, the Controller may charge the Data Subject a reasonable fee, in light of the administrative costs incurred to manage his or her request, or refuse the request.
